DISCLAIMER
1. MODIFICATION
Plus reserves the right in its discretion to change at any time without prior warning or notice any information or material contained on this App and is entitled to from time to time amend the terms and conditions under which this App is used. We will do this by updating the wording on this page and updating the publication date at the top of this page.
You will not necessarily be directly notified of such a change. Therefore, please ensure that you regularly check these Terms so you are fully aware of any changes or updates. If you continue to access this App or use any of the Plus online services after such modification, you are regarded to have agreed to be bound by such modified information, material, and terms and conditions.
2. INTERPRETATION
Plus is an App that allows one (must be 18 or older) to buy financial products. Plus is registered in Ghana as a product of 10th Capital Investments Limited , with limited liability by Companies Act, 1963 (Act 179) and Ghana Companies Act 2019 (ACT 992), with its Principal Office at Y21B Agostinho Neto Road Airport Residential Area , Accra Ghana. The term “Plus App”, “our”, “we” or “us” means Plus and/or any of its affiliates (including its direct and indirect subsidiaries) where relevant.
Plus is authorised by and regulated by the Securities Exchange Commissions, Ghana.
What We Mean By
- "Account" means any and all accounts which is accessed by you through Electronic Services.
- "Authorised User" means any person(s) authorised by you or your joint account holder from time to time to use the Electronic Services in relation to your Account.
- “Card” means any card (including any debit, credit or charge card) issued by a financial institution and on the VISA platform to access our Electronic Services.
- “Channel" means any mode of access to our Electronic Services. "Channel" includes Content.
- “Content” refers to any information, images, links, sounds, graphics, videos, software or other materials including quotes, news and research data that are available through our Electronic Services.
- "Electronic or App Instructions" means any Electronic Payment instructions, communications, instructions, orders, messages, data, information or other materials received by us through Electronic Services, which we reasonably believe come from you or your Authorised User.
- "Electronic Payment or App Payments" means any payments or transactions initiated or effected from your Account through Electronic Services.
- "Electronic or App Services" means any investment and other services or facilities which we may offer to you from time to time via electronic means, including any modification thereof made by us (the scope and nature of which shall be determined at our sole discretion). They may include investment via any Channel, electronic statements, electronic advices, transaction alerts, Cards or any electronic modes of operating the Account in or outside Ghana.
- "Plus App” means Internet/mobile investment services or other digital services relating to the Account that we offer to you from time to time through the Channel.
- "Information" means information regarding the money or other relevant particulars relating to you, or any Authorised User, or the Account or any Electronic Instructions.
- “Licensors” means a person or organization who gives another person or organization official permission to make, do, or own something. For Plus, this is the Security Exchange Commission, Ghana.
"Provider" means:
- any person (individual or non-individual) in Ghana or otherwise, which offer services or products, directly or indirectly through the Electronic Services;
- any person to whom we outsource certain functions or activities and source products from to allow us to operate our Electronic Services;
- any government, regulator, law enforcement agency, financial institution, and ancillary service provider (for example, telecommunication, internet access, cloud network, logistics, facilities management, data centres, system hosting, call centres, equipment and software providers), agent or subcontractor involved in our provision of Electronic Services; and
- our agents or storage or archival service providers for the purpose of making, printing, recording, mailing, storage, and/or filing any documents or items on which such information appear.
- "Security Codes" means personal identification numbers, passwords, one-time password (OTP), also known as a one-time PIN or dynamic password personal identifiers, biometrics identifiers, digital identifiers, other codes and verification procedures whether set by you or us that would allow you access to our Electronic Services.
- "Security Devices" means any physical device, equipment, software or technology that we may issue you to enable you access to our Electronic App Services, including a hardware token, software token, tags, apple watch or different tools that we may introduce in the future.
3. JURISDICTION AND RESTRICTION
Plus controls and maintains this App from Ghana. The materials and information contained in this section of this App, relating to Ghana, is directed at but not restricted to individuals resident in or entities having a place of business in Ghana ONLY. Plus makes no representation that the materials and information contained herein is appropriate or available for use in other locations/jurisdictions.
These Terms and Conditions are governed by and construed in accordance with the laws of Ghana and any dispute relating thereto shall be subject to the non-exclusive jurisdiction of the courts of Ghana.
4. MATERIALS AND INFORMATION
Materials and information contained in this App should not be regarded as an offer or solicitation to buy or sell any products or services in any country to any person to whom it is unlawful to make such an offer or solicitation. For materials or information relating to any external third parties or their products or services, it is retransmitted by Plus in the ordinary course of business to you for information and reference only. Plus, its officers, employees, and agents do not devise, select, add to, modify or otherwise exercise control over the contents of this App, and do not accept any responsibility whatsoever for it nor do they be regarded as having endorsed such material or information or any part thereof.
Materials, information, marks and logos contained in or displayed on this App are protected by intellectual property rights under applicable laws. No part of these material, information, marks and logos may be modified, reproduced, stored in a retrieval system, transmitted, copied, distributed or used in any other way for any commercial or public purposes without the written permission of Plus or the party owing these material, information, marks and logos.
5. USE
This App is comprised of various pages. Some sections or pages may be subject to separate terms, which are supplemental to these Terms. You should ensure you read any additional terms carefully. By accessing and using any page, you agree to be bound by the applicable supplemental terms. In the event of a conflict, the supplemental terms shall take precedence over these Terms.
Access to certain parts of the Plus App, or the products and services described on the Plus App may be subject to prohibitions or restrictions which apply in respect of certain people in certain countries/states. You should not use or access any part of the Plus App, to which prohibitions or restrictions apply, if you are not authorised to do so. By accessing and/or using the Plus App, you represent and warrant that such access and/ or use will not cause you, and/ or will not cause Plus, to breach any applicable law or regulation.
Plus reserves the right, in its sole discretion and without notice, to suspend and/ or block access to the Plus App for any reason and/ or to change any part of the Plus App including, but not limited to, the information contained upon the Plus App, the functionality of the Plus App and the layout and look of the Plus App. Plus may discontinue or change any product or service described or offered on the Plus App, at any time, without notice.
This Plus App aims at providing you with information concerning the products and services offered by Plus. These products are the property of but not limited to Bank of Ghana, Stanbic Investment Management Services LTD, Databank Asset Management Services LTD, Zenith Bank, GT Bank and Ecobank; Plus does not represent these products beyond providing aggregation. The Plus App is for allowing transactions to be completed and does not take responsibility for investment decisions made as a result of the information from the Plus App. The information provided on the Plus App is not to be construed as:
an offer of products or services; a proposal or inducement to make investments or to undertake arbitration in securities; an inducement to purchase or sell securities or any other product; a recommendation; all or part of a contract.
You acknowledge that you have the skills, training and equipment necessary to access and use the Plus App and the functionality contained within it.
6. ASSIGNING OF RIGHTS
The Plus app through its SEC Licenced entity, 10th Capital Investments acts as an intermediary between Plus clients and all underlying assets. The funds are pooled and invested on behalf of clients that making 10th Capital the sole representative of its client with the underlying Collective Investments Schemes (“CIS”).
As such, by purchasing products through are app, you agree to assign all rights including voting rights to 10th Capital Investments Limited to act on your behalf.
The Client agrees that any claims arising from delays or losses related to their investment shall be directed exclusively to 10th Capital Investment and not directly to the underlying asset managers.
10th Capital Investment shall, in turn, seek recourse from the relevant asset managers for any delays or losses incurred in accordance with its agreements with such managers. However, 10th Capital Investment does not guarantee the performance of any investment and shall not be held liable for market-related losses or risks inherent to the investment products offered through the Plus App.
10th Capital will ensure to act in the best interest of its clients and fairly represent our client’s views in engaging the various CIS fund managers. 10th Capital acknowledges and agrees that it is solely responsible for ensuring that clients’ redemption requests are properly submitted to the fund company and honouring the clients’ redemption requests.
7. VIRUSES, HACKING AND OTHER OFFENCES
You must not misuse our Plus App by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Plus App, the server on which our Plus App is stored or any server, computer or database connected to our Plus App. You must not attack our Plus App via a denial-of-service attack or a distributed denial-of-service attack.
It should be noted that it is a criminal offence to access or remain fraudulently in a computer system, to hinder or distort the functioning of such system, or to introduce data to or modify fraudulently the data in a computer system. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Plus App will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Plus App or to your downloading of any material posted on it.
8. INTELLECTUAL PROPERTY
Plus and/or its licensors own all of the items that make up the Plus App, particularly the information, data, designs, graphics, photographs, audio recordings and video recordings. The information held on this Plus App is for your own personal and/ or internal business use only. The information and other material on the Plus App may not be reproduced, represented, distributed or transmitted to any other person by any means whatsoever, whether in whole or in part, without the prior express authorisation of Plus. Any such action would constitute an infringement of rights and Plus may take appropriate legal action to enforce its rights.
The content on the Plus App may not be taken out of context or presented in an inaccurate, misleading, unfair or discriminatory way.
All trademarks (whether registered or unregistered) used on the Plus App are the property of Plus or its licensors. The trademarks may not be reproduced or used in any way, whether in whole or in part, without the prior authorisation of Plus.
You agree not to remove any copyright notice or other notice signifying Plus’s or any other third party’s intellectual property rights.
Except as expressly provided herein, nothing in these Terms or contained on the Plus App shall be deemed or construed to grant any licence or right, expressly, by implication or otherwise of any Plus intellectual property rights.
9. LIABILITY
Nothing in these Terms shall exclude or limit any person’s liability for (a) death or personal injury caused by its negligence, or (b) fraud. Nothing in these Terms shall exclude or limit any obligation which Plus has under Security Exchange Commission, Registrar General, The Ghana Company Acts in whole or in part.
Subject to the paragraph directly above neither Plus nor any of its group members, agents, licensors or delegates or its or their directors, officers or employees will be liable for any Losses, including, but not limited to Losses incurred or suffered by you directly or indirectly in connection with:
- your access to, use of or inability to access or use, the Plus App (whether in whole or in part and whether or not within the control of Plus);
- the suitability or otherwise of the Plus App or the information upon the Plus App for any particular purpose;
- any delay, error or omission regarding the contents of the Plus App;
- any information provided being corrupted, wrong or inaccurate; or
- the acts or omissions of you or any third parties, including, but not limited to, the act or omissions of third parties in making the Plus App and providing information to be used on the Plus App.
For the purposes of these Terms, Loss shall mean “loss, damage or expense whether direct or indirect, including any loss of profit, loss of revenue, loss of opportunity, loss of contract, loss of goodwill, loss of reputation, loss of fees, increased cost of working, any indirect, consequential, special, punitive, or incidental loss, or any loss resulting from liability to any other person (and in each case whether the foregoing arise in contract, tort, negligence or otherwise)”.
The information provided on the Plus App is provided “as is” and Plus shall have no obligation to amend or update any information provided. We do not represent that such information is accurate or complete and you should not rely on it as such. Plus does not give any express or implied warranty on the suitability of the Plus App for any particular purpose. Plus does not make or provide any representation or warranty or condition of any kind, implied, express or statutory regarding the Plus App, including, but not limited to information upon the Plus App.
Subject to this section (Liability) the total aggregate liability of Plus for all losses arising out of or in connection with these Terms and the Plus App shall be GHS 0. In addition, in the event of any inconsistency between this section (Liability) and any other provision in these Terms, this section will prevail.
You agree that the exclusions and limitations set out in these Terms are reasonable in light of the nature of the Plus App and the technology used to underpin the Plus App (including that the internet is not a completely reliable transmission medium).
We accept no liability howsoever caused (to the maximum extent permitted by applicable law) arising out of the use of or access to this App (which includes without limitation) any errors or omissions contained in this App or if the App is unavailable and we shall not be liable for any direct or indirect:
- economic losses (including without limitation loss of revenues, data, profits, contracts, use, opportunity, business or anticipated savings)
- loss of goodwill or reputation
- loss or damage which was not reasonably foreseeable, suffered or incurred arising out of or in connection with your use of this App and these terms and conditions
Access to and use of this App is at your own risk and we do not warrant that the use of this App or any material downloaded from it will not cause damage to any property, or otherwise minimise or eliminate the inherent risks of the internet including but not limited to loss of data, computer virus infection, spyware, malicious software, trojans and worms. Also, we accept no liability in respect of losses or damages arising out of changes made to the content of this App by unauthorised third parties.
To provide increased value to users of this App, we may provide links to other Apps or resources (that are not part of Plus) for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked App we are not responsible for the availability of such external Plus Apps or resources, and that we do not review or endorse and shall not be responsible or liable, directly or indirectly.
For (i) the privacy practices of such Apps, (ii) the content of such Apps, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such Apps or resources or (iii) the use that others make of these Apps or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external Apps or resources.
Certain content posted on this/of the Plus App is created by members of the public. The views and opinions expressed are theirs and unless specifically stated are not those of Plus. Plus is not responsible for, and does not endorse unless specifically stated, any content posted by members of the public on this App.
10. CONFIDENTIALITY
The internet and emails may not be a suitable way to send confidential information as such communications may not be secure. Plus therefore recommends that you do not use this means of transferring confidential information, unless additional security methods, such as encryption technology, are adopted. Plus does not accept any responsibility for any confidential information sent to us via the internet or email.
11. EXTERNAL APPS
The Plus App may contain links to third party Apps not controlled by Plus. These Apps, and the products and services contained on such Apps, are not endorsed by Plus and Plus has not verified the truth, accuracy, authenticity or reliability of the content of any such Plus Apps. You use such Apps entirely at your own risk and Plus shall have no liability in respect of the content, use or availability of external Plus Apps that you are able to access through the Plus App.
This Plus App may contain some material provided by third parties. Plus accepts no responsibility or liability for the accuracy, authenticity or reliability of such material.
No third party is permitted to link any App to this Plus App without Plus’s prior written consent.
12. PRIVACY AND ANALYTICS
Plus may process your personal data such as but not limited to KYC as part of and/or in connection with your use and access to the investment aspects of this Plus App for the sole purpose of the app functioning as it should as well as information required by the Security Exchange Commission (SEC) and any other regulators. This may include using analytics or similar technology to collect information about your use of the Plus App.
By accessing and/ or using the Plus App you acknowledge that you have been informed that analytics are used on this App and consent to Plus processing your personal data and using Analytics. You agree that if you choose not to permit Plus to use this data Plus may not be legally allowed to enable you to buy investment products.
13. NAVIGATION, ACCESS AND SECURITY
i. SECURITY
At Plus, we are aware of the need to guarantee the transfer of information between Plus and its customers. For this reason, Plus has maximum security measures to guarantee the confidentiality of communications between Plus and its customers. Transactional services operate on a secure server using SSL protocol (Secure Socket Layer), which is always activated when you log on to the service. The secure server establishes a connection so that the information is transmitted encoded in 128-bit algorithms, thus ensuring that they are only intelligible to the customer’s computer and Plus’s server. When using the SSL protocol, you are therefore guaranteed:
- That customers are sending their details to the Plus server center, and not to any other party that may try to simulate being Plus.
- That all data is encrypted between the client and the Plus server center, thus preventing their possible reading or manipulation by third parties.
And remember that Plus will never send you a request for personal data by e-mail. If you receive a message of this type, please do not provide any details and contact Plus immediately at info@plusapp.online.
ii. DATA PRIVACY
Unless restricted by applicable laws, you agree that any and all personal information/data relating to you collected by Plus from this App may from time to time be used and disclosed for such purposes and to such persons as may be in accordance with the laws of Ghana.
14. DISCLAIMER: INVESTMENT PRODUCTS
The price of securities can and does fluctuate, and any individual security may experience upward or downward movements, and may even become valueless. There is an inherent risk that losses may be incurred rather than profit made as a result of buying and selling securities.
The risk of loss in trading futures contracts or options can be substantial. In some circumstances, you may sustain losses in excess of your initial margin funds. Placing contingent orders, such as “stop-loss” or “stop-limit” orders, will not necessarily achieve the desired results. Market conditions may make it impossible to execute such orders. You may be called upon at short notice to deposit additional margin funds. If the required funds are not provided within the prescribed time, your position may be liquidated. You will remain liable for any resulting deficit in your account. You should therefore study and understand futures contracts and options before you trade and carefully consider whether such trading is suitable in the light of your own investment objectives, financial circumstances, tolerance to risks and investment experience.
You should also read any risk disclosure statement contained in any particular investment product you intend to purchase, subscribe or trade. If in doubt, please seek specific professional advice.
15. INDEMNITY
You hereby agree to indemnify and to keep plus fully and effectively indemnified against any action, liability, cost, claim, loss, damage, proceeding or expense (including legal fees, costs and expenses on a full indemnity basis) suffered or incurred by plus arising from or which is directly or indirectly related to:
Using Plus for criminal activity, illegal activities, activities such as creating an account to manage a third parties’ money as well as any activity that uses Plus as a proxy.
16. TERMINATION
Plus may terminate these terms and conditions, your access to this App and use of online services at any time, without prior notice to you.
17. PERSONAL DATA PROTECTION POLICY
i. What is the purpose of this Personal Data Protection Policy?
This personal data protection policy (“Personal Data Protection Policy”) aims to make people aware of how we collect, process and protect the personal data you provide or collect through our App (the “Plus”) by means of forms and/or Analytics so that you can freely and voluntarily decide whether you want us to process them. When you contract products or services with us (“Plus”) the personal data will be processed in accordance with the provisions of the corresponding document. The App is owned by 10th Capital.
In this document we inform you about the processing of the information that Plus obtains through the App but it is not applicable to the information that can be obtained by third parties on other Apps, even if they are linked by the App.
We remind you of the importance of reading this Personal Data Protection Policy every time you use the App, as it may be modified.

What do we use your personal data for?
- To manage your activities through the App in accordance with the cookie policy that you can view in this document.
- For the purposes and legitimized purposes indicated on each of the personal data collection forms on the App including but not limited to Know Your Client (KYC) information which is required by the Security Exchange Commission .
At Plus we treat your personal data with the utmost confidentiality. We undertake not to disclose such data and guarantee our duty to safeguard them by adopting all necessary measures to avoid their alteration, loss and unauthorized processing or access, in accordance with the legal obligations that apply to us as being responsible for the processing of your personal data.
Plus has put in place and maintains the highest levels of security as required by law to protect your personal data against incidental loss and access and unauthorized processing or disclosure, in consideration of the state of technology, the nature of the data stored and the risks they are exposed to.
ii. Will Plus send you commercial communications?
Through the data collection forms Plus may obtain your consent to contact you by post, e-mail, SMS, or any other equivalent electronic means of communication, to send you commercial communications about their own products and/or third parties identified in the form.
If at any particular time you do not wish to continue receiving these kind of communications, you may revoke your consent by sending notification to the following address support@plusapp.online, providing a copy of a document/using the email used to operate the app, that allows proof of identity, or using the link provided for this purpose in the commercial communications you receive.
iii. How long will we keep your data?
During the time specified in the form that, if applicable, we provide you with to give your personal data to Plus, as well as the period of time indicated in the App.
iv. To whom will we communicate your data?
We will not pass on your personal data to third parties unless we are required to do so by law or you provide your consent.
When your consent is required to communicate your personal data to third parties, we will inform you in the data collection forms of the purpose of the processing, the data to be communicated as well as the identity or areas of activity of the possible assignees of your personal data.
In order to provide you with a suitable service and manage the relationship we maintain with you as a user, we might communicate your data to telecommunications companies that process your information on behalf of Plus, as part of service provision agreements with them.
Furthermore, we would like to inform you that, for the same purpose as indicated in the previous paragraph, certain companies that provide services to Plus may have access to your personal data (international data transfers). These transfers are made to countries with a level of protection comparable to that of the European Union (suitability decisions made by the European Commission, standard contractual clauses and certification mechanisms). v. Does Plus use links to other Apps?
The App may contain links to other Apps. Please note that Plus is not responsible for the privacy and processing of personal data from other Apps. This Personal Data Protection Policy document applies exclusively to the information collected on the App by Plus. We recommend that you read the personal data processing policies of other Apps to which you link from our App or otherwise visit.

Likewise, at any time, you can withdraw your consent without affecting the lawfulness of the processing by sending your request to the email address support@plusapp.online. Remember to attach a copy of your ID card or equivalent document accrediting your identity to your application.
vii. What we would not ask you for
When you access your account, we need to check we’re dealing with you. We also need to check the request we’re following comes from you (or someone acting for you). If we get a payment, for example, we’ll check that the card or method is legit. If you're buying a product, we may ask for a photo ID (eg Ghana Card or passport) as part of your KYC information. For everything else, e.g. logging in, if your security details are used, we’ll assume it’s you. We’ll treat the request as if you had authorised it. That’s why you must be very careful to keep your security details private and not let anyone get access to any devices you use to make payments. We may add other ways of checking your identity in the future. What do we mean by ‘security details’? We ask for security details to keep your account safe. We’ve set out some types of security details below. Access to our services for everyone We usually communicate in English. Useful information for you Passwords, PINs, security codes, and memorable data. Biometric data (such as a fingerprint or voice ID). The codes and passwords you set up with us for Telephone, Online or Mobile investment. any information you use with a Mobile device. What do we mean by ‘Mobile device’? - Safely destroy any security details we send you e.g. if we send you an sms confirming your OTP.
- Use different security details for different things e.g. use a different password for the Plus App.
- Take care when using your security details. Make sure no one can hear or see your security details when you use them.
- Change your security details straight away and tell us as soon as possible if you suspect, or you know, that someone else knows your details.
- Take care when you transfer a Mobile device to someone else
That’s why you must be very careful to keep your security details private and not let anyone get access to any devices you use to make payments. 18. AGGREGATION SERVICES
Some companies may offer aggregation Apps and services that allow you to consolidate your account information from different sources (such as your accounts with us or with other financial institutions) so that you can view it in one location or perform actions related to your accounts using their services (a “Provider”). To do this, a Provider may request you to authorize access to your Plus accounts by providing your Plus username and passcode or by providing your information-sharing consent directly to Plus through your Plus App account.
- The Provider may access, on your behalf, information about yourself, your Plus relationship, and your accounts at Plus.
- You should use caution and ensure that the Provider has appropriate policies and practices to protect the privacy and security of any personal information you provide or to which they are gaining access.
- Use of your personal information by the Provider is governed by your agreement with them, not by Plus.
- We are not responsible for the use or disclosure of any personal information accessed by any company or person to whom you provide your username and passcode.
- If you share your Plus username and passcode or other information about your accounts with others, we will consider that you have authorized any transaction or action initiated by using the access information you provide.
- If you decide to revoke the authority you have given to a Provider, we strongly recommend that you change your Plus passcode to ensure that the Provider cannot continue to access your account.
- You may revoke your consent for certain Providers through the Security Center within Plus Plus App.
19. SOCIAL MEDIA
Plus engages with customers on social media platforms such as Facebook®, Twitter®, YouTube® and LinkedIn®.
- Any content you post on official Plus managed social media pages, such as pictures, information, opinions or any personal information that you make available to other participants on these social platforms, is subject to the Terms of Use and Privacy Policies of those respective platforms.
- When interacting with official Plus social media pages, Plus’s privacy notices, Social Media User Terms and Conditions apply.
- Please review the privacy policy for the specific social media service you are using to better understand your rights and obligations with regard to such content.
We may allow certain non-affiliated third-party widgets (for example social share buttons) on our Plus Apps that enable users to easily share information on another platform, such as a social media platform. The non-affiliated third parties that own these widgets may have access to information about your browsing on pages of our Plus Apps and Mobile Apps where these widgets are placed.
20. PLUS SOCIAL MEDIA TERMS OF USE
These terms govern our social media-based Apps, accounts, pages and applications (or collectively, our "Plus Apps") that belong to, or are managed by Plus. By accessing our Plus Apps, you are agreeing to be bound by these terms, all applicable laws and regulations, and any other applicable policies, terms and guidelines established by Plus and those of any third parties that host our Plus Apps (such as Facebook or Twitter). If you do not agree with any of these terms, do not use or access our Plus Apps.
21. Use Limitations
You agree to comply with all of Plus Social Media Community Guidelines with regard to any content that you post/share on our Plus Apps, and you agree to our right to moderate and delete any content at our sole discretion. You also agree that your activities on our Plus Apps will not violate any applicable law, regulation or terms of any existing agreements you may have with Plus. Any unauthorized use of our Plus Apps or misuse of any information posted to a Plus App is strictly prohibited.
22. Copyright/Use Licence
The content provided in our Plus Apps is owned or Licenced by Plus, unless otherwise indicated. Permission is granted to temporarily download one copy of Plus-provided content on Plus's Plus Apps for personal, non-commercial use only. This is the grant of a Licence, not a transfer of title, and under this Licence you may not:
- modify or copy the materials except as otherwise provided;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- remove any copyright or other proprietary notices from the materials; or
- transfer the materials to another person or "mirror" the materials on any other server.
This Licence shall automatically terminate if you violate any of these restrictions and may be terminated by Plus at any time. Upon terminating your viewing of these materials or upon the termination of this Licence, you must destroy any downloaded materials in your possession, whether in electronic or printed format.
23.PLUS APP MODIFICATION OR TERMINATION
Plus may modify the features, content and functionality of its Plus Apps, or terminate entirely its Plus App, at any time without prior notice or liability to you. Modification or termination of these terms will not affect, or result in the termination or modification, of any other existing agreements you may have with Plus.
24.PLUS APP "TERMS OF USE" MODIFICATIONS
Plus may revise these terms of use for its Plus Apps at any time without notice. By using these Plus Apps you are agreeing to be bound by the then current version of these terms of use. Any modifications to these terms shall be effective as of the date posted.
25.RELATIONSHIP
Your use of our Plus in no way shall be deemed to create an agency or employee-employer relationship of any kind between you and Plus, nor do these terms extend rights to any third party. You also agree that in the course of your accessing and using our Plus Apps, that no relationship is formed between yourself and Plus that is either confidential or fiduciary in nature beyond any existing relationship you may have with us.
26.Service Charges
Plus charges a fee to process payments this includes the platforms Plus uses such as but not limited to Visa, Paystack, Mobile Money.
In addition to the fees already described in this Agreement, you should note that depending on how you access the Services, you might incur charges for:
- Normal account fees and service charges, such as withdrawal payment requests, check copy orders and account statement copy orders.
- Internet service provider fees.
- Wireless carrier fees.
- A non-sufficient funds fee, returned item, overdraft or similar fee may also apply if you schedule payments or transfers and your available balance is not sufficient to process the transaction on the date scheduled or, in the case of a personal check used for a bill payment, on the date when the check is presented to us for payment.
Service Hours
The Services are available 365 days a year and 24 hours a day, except during system maintenance and upgrades. When this occurs, a message will be displayed when you sign on to Plus App.
27.Cancellation
The Services remain in effect until they are terminated by you or Plus. You may cancel one or more of your Services at any time by notifying us of your intent to cancel in writing, through Plus App secure mail, or by emailing info@plusapp.online. This cancellation applies to your Services, and does not terminate your Plus accounts. We recommend that you cancel any scheduled payments prior to notifying us that you are discontinuing the Service. Otherwise, Plus will cancel any scheduled payments within two (2) business days from the date we receive your request to discontinue the Service.
We may terminate your participation in any or all of your Services for any reason, including inactivity, at any time. We will try to notify you in advance, but we are not obliged to do so.
i. CONSENT TO PROVIDE ELECTRONIC COMMUNICATIONS
As part of Plus App enrollment, you consented to the Plus App Electronic Communications Disclosure(“eCommunications Disclosure”) which allows us to provide you with account-related communications electronically. Pursuant to this consent, we will deliver these communications electronically by either posting the communication to our App, sending it to your email address or by other electronic means. You are responsible for providing us with a valid e-mail address to accept delivery of electronic communications and you must notify us of any changes or updates to your email address. You agree that once we email or post the communications within our App, we have delivered the Communications to you in a form that you can retain. You have the option to view, save, or print PDF versions of your account documents from the App via desktop, tablet or mobile device.
ii. INTELLECTUAL PROPERTY RIGHTS
All contents of this App including but not limited to the texts, graphics, links and sounds are the copyright of Plus PLC and may not be copied, downloaded, distributed or published in any way without the prior written consent of Plus PLC.
“Plus”, “Plus App”, are registered trade marks and service marks of Plus PLC and no permission or Licence is granted to use any such trade marks or service marks without the prior written consent of Plus PLC. All other marks, names and logos used on this App relating to companies within the Plus Group or to their products or services are the intellectual property rights held by companies within the Plus Group unless otherwise stated.
In relation to any information or materials which you submit to Plus using this App, you hereby grant to Plus a worldwide royalty-free perpetual licence of the copyright and intellectual property rights in such information or materials for any purpose it deems including, without limitation, the copying, transaction, distribution and publication thereof, unless restricted by applicable laws.
You agree that Plus shall not be under any obligation of confidentiality to you regarding any such information or material submitted to it using this App unless agreed otherwise in a separate direct contract between you and Plus or required by applicable laws.
You acknowledge that the contents of the foregoing provisions shall not limit any specific provisions set out in the individual terms and conditions of particular products and services offered on or through this App.
28. UNSOLICITED IDEA SUBMISSION POLICY
Plus and its employees and contractors do not accept, review or consider any unsolicited ideas, works, materials, proposals, suggestions, artwork, content or the like, including for advertising campaigns, promotions, products, services, technologies, product enhancements, processes, marketing strategies, product names, content or creative materials (all of the foregoing “submissions”). Please do not send or provide any submissions in any form to Plus or any of its employees or contractors.
The purpose of this policy is to avoid potential misunderstandings or disputes when Plus products, services, technologies, advertising, promotions, marketing strategies or content might seem similar to submissions provided to Plus. If, following our request that you not give us your submissions, you send them anyway, then the following rules will apply to your submissions regardless of what your correspondence says.
Terms of Idea Submission
You agree that:
(1) your submissions and their contents along with related intellectual property rights will automatically become the property of Plus without any compensation to you;
(2) Plus may use or redistribute the submissions and their contents for any purpose and in any way on an unrestricted basis;
(3) there is no obligation for Plus to review the submissions; and
(4) there is no obligation to keep any submissions confidential.
Also
(a) your ideas will automatically become the property of Plus, without compensation to you,
(b) Plus can use the ideas for any purpose and in any way, and
(c) any information you provide will be considered non-confidential.

CHOICE OF LAW

If for any reason, a competent court finds any part of these Terms invalid, unlawful or unenforceable to any extent, Plus shall delete the relevant part from the Terms and the remainder of the Terms shall continue to be valid and enforceable to the fullest extent permitted by Ghana law.
These Terms together with any supplemental Plus App terms shall contain the entire agreement and understanding of the parties, and supersede all prior agreements, understandings or arrangements in relation to this Plus App.
You will be able to download, print and store a copy of these Terms for your personal use only. These Terms may not be used or copied for any business or other purpose.
